Course Objectives The practice of law now frequently calls on lawyers to have specialized research skills in international and foreign legal materials. This course will teach research methods to find and evaluate such materials using both electronic and print resources. Its principal purpose is to provide the basic knowledge and skills needed to conduct competent international and foreign legal research. It also has the secondary goal of expanding on and reinforcing the basic legal research skills that students had earlier learned in the first year of law school. In this course, you will become skilled in researching various international and foreign legal sources through practical application by doing in-class exercises and preparing an original legal research guide on a topic of your choice. In short, this is a course on international and foreign legal research sources and techniques. II. Assignments and Grading Grades are based on the following breakdown: 15% - In-Class Exercises, On-Time Attendance, and Participation in TWEN Readings Discussion Board (See detailed description in TWEN). 36% - Legal Research Guide (due on March 24). (See detailed description in TWEN). 15% - Legal Research Guide Presentation (to be given between March 29 and April 19), 1-Page Summary (due on the date of the presentation), and Meeting Deadlines. (See detailed description in TWEN). 34% - Final Exam (April 29) (See detailed description in TWEN). III. Class Preparation and Procedure The reading assignments and required CALI lessons are described in the Syllabus. There are three texts for this class; students need to purchase the first two. Two copies of the third text will be available on reserve at the Law Librarys Circulation Desk. (1) Hoffman & Berring, International Legal Research in a Nutshell (2008) [available for purchase at the SMU Barnes & Noble Bookstore on Mockingbird Ln. approx. $32] (2) Course Readings Packet [available for purchase at Alphagraphics, located at 3032 Mockingbird (between the SMU Barnes & Noble Bookstore and CVS Pharmacy) approx. $30]. (3) Hoffman & Rumsey, International and Foreign Legal Research: A Coursebook (2008). Students should complete the readings and relevant CALI lesson(s) before the corresponding class date. There is no Socratic Method in this class, but doing the readings in advance of the relevant class date will make the lectures more interesting and understandable. Carefully note the distinctions in the syllabus between required, skimming and optional readings. Questions regarding the optional readings will not appear on the final exam. When a section of the assigned readings takes the form of a bibliography or list of resources, it is sufficient to skim the bibliography/list. The goal of the readings is to provide you with a context for research in the relevant area of law, not to make you memorize the names of sources or other minutiae. The instructor will hand out an outline of each days lecture at the beginning of each class meeting so that you will not feel compelled to take copious notes or write down the URLs of the websites mentioned in class. But you should take notes from the lectures to supplement the outline, as appropriate. After class, you should visit each website for which a URL is provided in the outline for at least 3 minutes or so to become generally familiar with it. The planned format for each class is: First-half: instructors lecture; Second-half: students do in-class exercises on their portable computers, with instructor available to help. But, in practice, this format will be flexible. The instructor will endeavor to allocate a reasonable amount of time for lectures and exercises, spread over the two class periods held each week. IV. Items to Bring to Each Class Meeting Portable Computer with Internet access; Course texts (from time to time, I may refer to specific portions of the readings during class); V. Class Attendance and On-Time Policy On-time class attendance is compulsory. As a practical skills course, students would not benefit from it without doing the in-class research exercises. Students may miss (or be late for) up to three classes without penalty. But if a student misses or is late for more than three classes, then the student will receive less credit (5% per occurrence). If a student misses or is late for more than five classes, then the student will not pass the course. With the instructors permission, credit for in-class exercises missed (up to a maximum of two occurrences) may be obtained by doing the exercises outside of class. VI. Deadlines The deadlines for turning in work for this class are as follows: February 15 Legal Research Guide Topic Selection (this is not graded; please send me your topic by e-mail, and I will provide feedback) March 3 Legal Research Guide Guiding Hypothetical Paragraph (this is not graded; please send my your paragraph by e-mail, and I will provide feedback) March 24 Legal Research Guide (a paper copy must be turned in at the beginning of class; please also submit them by e-mail but the official version will be the print version you turn in; on the date of your presentation also provide a 1-page summary of the contents of your presentation to be distributed to the other students in the class) April 29 Final Exam [Closed Book] (can be taken by ExamSoft or in writing at the students option) 5% of credit will be taken away per day per missed deadline. VII. Office Hours My office is located on the southwest corner of the third floor of the Underwood Law Library. I am usually either there, or at the Reference Office on the second floor of the Underwood Law Library, during most weekday hours during the day until 3:30 pm (but not during lunch). On Friday mornings (10 am 1 pm), I will usually be staffing the law librarys reference office on the second floor of the law library, which is a good time to meet with me. For office visits, no appointment is necessary, but setting one up may be helpful to ensure that you will be able to meet with me at a convenient time and that I will be ready to discuss your questions.
